1. Introduction and Acceptance of Terms

1.1 Welcome to GoalScript, a productivity and goal-setting application provided by PRIMEPEAK INC. (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the GoalScript application (“Service”), available on iOS, as well as through our website at primepeak.io (the “Site”).

1.2 By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our Service. Your continued use of the Service constitutes acceptance of these Terms.

1.5 Brief Summary of the Service

GoalScript is a local-first, goal-setting and productivity application designed to help users transform their aspirations into achievable daily actions. Our Service includes tools for goal management, habit tracking, task organization, progress tracking, and achievement recognition. All user data — including goals, tasks, entries, and progress — is stored locally on your device. No account creation or sign-in is required to use the Service.

2. Eligibility and Age Restriction

2.1 Eligibility

To use the Service, you must be at least 13 years old. By using the Service, you confirm that you meet this age requirement.

2.2 Children's Guidelines

Our Service is not directed at children under 13, and we do not knowingly collect personal information from them. If we become aware of such data collection, we will delete the information. If you believe we may have inadvertently collected information from a child, please contact us at info@primepeak.io.

3. Privacy and Data Collection

3.1 Your privacy is important to us. Our Privacy Policy explains how we collect, use, share, and protect your data. This policy is compliant with GDPR, CCPA, and other international privacy laws and is available at primepeak.io/privacy.

3.2 Local-First Data Storage

GoalScript operates on a local-first architecture. All user-created content — including goals, habits, tasks, progress entries, and activity data — is stored exclusively on your device. We do not maintain server-side databases or accounts for storing your personal productivity data. You are solely responsible for the data stored on your device, including maintaining backups.

3.3 Third-Party Services

We use the following third-party services for limited operational purposes:

3.3.1 RevenueCat (revenuecat.com): Payment processing for in-app subscriptions and purchases. RevenueCat identifies your device using an anonymous local identifier — no personal account information is required.

3.3.2 Mixpanel (mixpanel.com), PostHog (posthog.com), and Vercel Analytics (vercel.com/docs/analytics): Anonymous usage analytics and user behavior tracking to help us improve the Service.

3.3.3 Sentry (sentry.io): Error tracking and performance monitoring to improve app stability.

3.3.4 Expo Application Services (EAS) (expo.dev/eas): Development and deployment for mobile applications.

3.3.5 Vercel (vercel.com): Hosting and deploying the marketing website.

3.3.6 CDN (cdnjs.cloudflare.com): Content delivery for external scripts.

4. No Account Required

4.1 GoalScript does not require account creation, registration, or sign-in. The Service operates without user accounts, and no personal credentials are stored on our servers. Your data resides solely on your device.

4.2 Because all data is stored locally, you are responsible for the security of your device and the data stored on it. PRIMEPEAK INC. is not responsible for any data loss resulting from device loss, damage, or unauthorized access to your device.

5. Data Retention and Deletion for Legacy Versions

5.1 Applicability

This section applies to users who access or have accessed the Service through app versions prior to 4.0, which utilized an authentication-based flow requiring account creation and server-side data storage ("Legacy Versions").

5.2 Legacy Data Storage

Unlike the current local-first architecture (version 4.0 and above), Legacy Versions stored user-created content — including goals, habits, tasks, progress entries, and activity data — on our servers in association with your account.

5.3 Inactive Account Data Deletion

If you are using a Legacy Version and have not opened or accessed the Service for a continuous period of ninety (90) days, as determined by the last recorded app activity timestamp, PRIMEPEAK INC. reserves the right to permanently delete all data associated with your account from our servers. This deletion is performed as part of our ongoing data cleanup and security initiatives.

5.4 Deletion Is Permanent

Once your data has been deleted under this policy, it cannot be recovered. PRIMEPEAK INC. shall not be liable for any loss of data resulting from deletion carried out in accordance with this section.

5.5 Recommendation to Upgrade

We strongly encourage all users on Legacy Versions to upgrade to version 4.0 or later, which operates on a local-first architecture and does not rely on server-side data storage. By upgrading, your data is stored exclusively on your device and is not subject to this data retention policy.

6. Subscription and Payment Terms

6.1 Some features of GoalScript are available through paid subscription plans. We offer a free trial period followed by monthly or annual subscription options. Current pricing is displayed within the app at the time of purchase. Payments are securely processed through RevenueCat (revenuecat.com). All applicable fees are displayed at the time of purchase and are non-refundable unless required by law.

6.2 Free Trial

New users are eligible for a free trial of our premium features. The trial period begins when you start your subscription. You will not be charged during the trial period. After the trial ends, your selected subscription plan (monthly or annual) will automatically begin unless canceled.

6.3 Automatic Renewal

Subscriptions renew automatically at the end of each billing period unless canceled at least 24 hours before the renewal date. You authorize us to charge your payment method for the recurring fees at the then-current subscription rate. You can manage your subscription settings through the App Store.

7. Subscription Information and Refund Policy

7.1 Subscription Information

Subscriptions are personal, non-transferable, and tied to your device and app store account. Premium features are unlocked on the device where the subscription is active.

7.2 Refund Policy

Refunds are generally not provided, except in cases of technical issues attributable to us or as required by applicable law. To request a refund, please contact info@primepeak.io.

8. Acceptable Use of the Site

8.1 You agree to use the Service only for lawful purposes and in a manner that does not infringe upon the rights of others or disrupt the Service.

8.2 Prohibited activities include, but are not limited to:

8.2.1 Violating any applicable laws or regulations.

8.2.2 Engaging in unauthorized access to other accounts or systems.

8.2.3 Distributing viruses, malware, or harmful software.

8.2.4 Interfering with the integrity, security, or functionality of the Service.

8.3 Violations may result in the restriction or termination of your access to the Service and may be subject to civil and criminal liability.

9. Security Rules

9.1 You are prohibited from attempting to compromise the security of the Service, including unauthorized access, testing vulnerabilities, or circumventing security measures. PRIMEPEAK INC. reserves the right to investigate and prosecute violations to the fullest extent of the law.

10. Intellectual Property Rights

10.1 All content, features, and functionality within GoalScript, including text, graphics, logos, icons, images, and software, are the exclusive property of PRIMEPEAK INC. or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

10.2 License and Restrictions

PRIMEPEAK INC. grants you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial use only. Unauthorized use or duplication of materials is strictly prohibited.

10.3 Trademarks

The names “GoalScript” and “PRIMEPEAK INC.” and all related logos and taglines are trademarks of PRIMEPEAK INC. You may not use these trademarks without our prior written consent.

11. Indemnification

11.1 You agree to indemnify, defend, and hold harmless PRIMEPEAK INC., its affiliates, and their employees from any claims, liabilities, damages, costs, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or any infringement of rights by you or any third party.

12. Limitations of Liability and Release

12.1 To the fullest extent permitted by law, PRIMEPEAK INC. and its affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of, or inability to use, the Service.

12.2 Aggregate Liability Cap. To the fullest extent permitted by applicable law, PRIMEPEAK INC.’s total cumulative liability to you for all claims arising out of or related to these Terms or the Service — whether in contract, tort (including negligence), strict liability, or any other legal theory — shall not exceed the greater of (a) the total amounts you have paid to PRIMEPEAK INC. for use of the Service in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) ten Canadian dollars (CAD $10.00).

12.3 PRIMEPEAK INC. is not responsible for any content, actions, or omissions of third parties involved in delivering the Service or supporting related functionality.

12.4 In jurisdictions that do not allow limitations of liability for certain damages, PRIMEPEAK INC.’s liability shall be limited to the maximum extent permitted by law.

13. Warranties

13.1 The Service is provided “as-is” and “as available.” PRIMEPEAK INC. makes no warranties, express or implied, regarding the accuracy, completeness, reliability, or suitability of the Service for your needs.

13.2 PRIMEPEAK INC. disclaims any implied warranties of merchantability, fitness for a particular purpose, or non-infringement to the fullest extent permitted by law.

14. General Provisions

14.1 Entire Agreement

These Terms constitute the entire agreement between you and PRIMEPEAK INC. regarding your use of the Service and supersede any prior agreements.

14.2 Governing Law and Jurisdiction

These Terms are governed by the laws of Ontario, Canada. You agree to submit to the exclusive jurisdiction of the courts located in Toronto, ON, Canada, for any disputes arising from these Terms or the Service.

14.3 Severability

If any provision of these Terms is found to be invalid, the remaining provisions shall remain in full force and effect.

14.4 Waiver

The failure of PRIMEPEAK INC. to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
